The Confaz (National Council of Treasury Policy) and the Brazilian Democracy: a Happy Ending Story?

The Democratic State of Law inaugurated with the Constitution of 1988 is part of a complex system of principles, values and rules have long desired by society. Democracy, the objective pursued in most of the world even though it has been known since ancient Greece, only with Modernity gains reliefs of real people's participation in key decisions of the country. Thus, even if knowing that there is no possibility of offering a ready and finished concept for democracy, certain characters may be pointed out as fundamental to the current Brazilian democracy. The principles sprinkled in the Constitution of 1988 realize that popular sovereignty has to be the main vector of the democratic ideal, in which an eventual direct participation of the people or even the common actions through its representatives is sheltered. The objective of this work is to confront the National Council of Treasury Policy with the democratic ideal. It is proposed to foster in the law studious the interest on the adjustments made by that Council, assessing its relevance to the model of society which is expected to be being built. The methodology is bibliographic, descriptive and exploratory. The importance of the analysis of such theme resurges in a so economically and socially uneven federation, which makes one think of mechanisms to avoid so much inequality.Downloads
