Abstract

The present study pretends to revisit the so called Legal Garantism Theory formulated by Luigi Ferrajoli from the end of the 1980s, specially with the publication of Diritto e Ragione taking into consideration the importance of it for the contemporary legal thinking. For that it is sought to rebuild the first great discussion to which guarantism was submitted, still on the 1990s, when many metatheoretical, theoretical and political philosophical questions were raised. In summary it is a study focused on the diffusion of a garantism dimension which has been being neglected by jurists in terrae brasilis where the readings done during the last decades limited itself to aspects of criminal and criminal procedure law.
