Through historical, political and social facts, the great conquests achieved by women over the centuries in relation to work, which allows them to obtain freedom and independence, rights that for a long-time women did not have, and were not even considered as citizens by certain Constitutions, are demonstrated. A historical analysis of the Brazilian legal system reveals the gaps even in the CF/88. The absence of rules establishing rights appropriate to the time generates labor instability and inequality, and these facts are exposed. The conclusion is that it is important to raise awareness about the applicability of the principle of equality in all respects, and that the precariousness, especially economic, experienced is the result of the low
practice of labor standards that arose to equalize the male and female sexes, but which continue to fail to achieve this goal. It is therefore necessary to re evaluate the rules and adapt them to current daily life.
