This work proposes an analysis of the Enemy Criminal Law having as background the Abyssal Lines Theory developed by the Portuguese sociologist Boaventura de Sousa Santos. From the functionalist system defended by Günther Jakobs and the idea of enemy analyzed under a political, philosophical and normative bias it is intended to demonstrate, regardless the recurrent presence of the Enemy Criminal Law practices in the juridical ambit, its incompatibility with the ideal democratic rule-of-law state.Downloads
