6. Fame versus right to intimacy: the famous people’s privacy problem and the concretization of fundamental rights

This article aims to summarily present some relevant concepts about the constitutional fundamental rights and later deepen the studies on legal conflict between the rights to information and freedom of expression in light of the rights to privacy and intimacy, all assured by the Constitution of 1988. The doctrinaire and jurisprudential stream regarding such rights will be questioned, demonstrating the existence of legal uncertainties even in the most accepted doctrines. The brought up issue is developed following the approach of concrete situations, then questioning the solutions found. Ultimately, the coverage and limits of the rights to privacy and intimacy, especially with regard to their ownership by famous people will be addressed.Downloads
