Abstract

As of a synthesis of the evolution of the penal dogmatism, the intention is to understand the reasons that lead to the flourish of functionalism, the most modern theory among the ones so far developed (however it is still not the most accepted in Brazil) to try to relate this theory with the most important event that has happened on the contemporary philosophy, the linguistic turn. From this confront on, we will have the conditions to evaluate whether the recent theory of the punishable fact has achieved its goals and to what extent this theory is compatible with the Philosophy of Language and with the Democratic State of Law.
